Terms of Service — OK? Safety & Wellness Alert

These Terms of Service govern your use of the OK? — Safety & Wellness Alert iOS application ("App") and the website at okcheck.app ("Website"). By using the App or Website, you agree to be bound by these Terms. If you do not agree, do not use the App or Website.

1. Service Overview

OK? — Safety & Wellness Alert provides daily check-in reminders and optional alert email features. The App allows you to designate a guardian contact who may receive email notifications if you miss a check-in beyond your configured threshold or manually request assistance. Features may change over time to improve reliability and user experience.

2. NOT an Emergency Service

OK? — Safety & Wellness Alert is NOT an emergency response service, a substitute for 911 (or any local emergency number), a medical provider, a professional monitoring service, or a real-time tracking system.

The App is a personal communication support tool only. It does not dispatch emergency responders, provide medical advice, or guarantee that any person will receive or act upon a notification sent through the App. If you are experiencing a medical or safety emergency, call 911 or your local emergency number immediately.

3. Eligibility

App Store age rating: The App is rated 4+ on the Apple App Store. This rating reflects the App's content only (no violence, adult themes, or objectionable material) and does not imply that children of any age may independently use the App without parental involvement.

Users 13 and older may use the App independently, provided their use complies with these Terms and all applicable laws and platform requirements.

Users under 13 — parental consent required: Because the App involves configuration of personal information (name, email, phone number) and guardian contact details for emergency alert purposes, users under the age of 13 must have verifiable parental or legal guardian consent before using the App or providing any personal information. A parent or legal guardian must review these Terms and agree on behalf of the minor prior to use.

Parental responsibility: If you are a parent or legal guardian setting up the App for or on behalf of a minor, you accept these Terms on the minor's behalf and are responsible for their use of the App, including ensuring that guardian contact information entered belongs to a consenting adult.

4. Your Responsibilities

By using the App, you agree to:

Provide accurate information if you choose to enter it.
Obtain appropriate consent from any person you designate as a guardian contact before entering their information.
Maintain the security of your device and any accounts you use.
Use the App in a lawful manner and not attempt to disrupt or misuse the service.
Understand that the App does not independently verify your condition, location accuracy, or the completeness of any information you provide.

5. Alert Emails and Delivery Limitations

If you enable alert emails, OK? — Safety & Wellness Alert will attempt to send an email to your designated guardian contact when you trigger an alert or miss a check-in beyond your configured threshold. However:

Email delivery may be delayed, fail, or be filtered by the recipient's email provider.
Network availability, device settings, server outages, or other external factors may prevent delivery.
The App does not confirm whether the recipient has read, received, or acted upon any notification.
Location information, if included, is approximate and may be inaccurate.

You should not rely solely on this App for your safety. Always have alternative means of contacting emergency services or trusted persons.

6. Disclaimer of Warranties

THE APP AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT NOTIFICATIONS WILL BE DELIVERED SUCCESSFULLY.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER AND OPERATOR OF OK? (OKCHECK.APP) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF LIFE, INJURY, DATA, PROFITS, OR GOODWILL ARISING FROM OR RELATED TO: YOUR USE OF OR INABILITY TO USE THE APP; ANY FAILURE, DELAY, OR INACCURACY IN THE DELIVERY OF ALERT EMAILS; ANY ACTION OR INACTION BY A GUARDIAN CONTACT UPON RECEIVING A NOTIFICATION; ANY RELIANCE ON INFORMATION TRANSMITTED BY THE APP; OR UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO USE THE APP (WHICH IS ZERO FOR FREE USERS).

8. Indemnification

You agree to indemnify and hold harmless OkCheck.app, its developer, and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

9. Privacy

Your use of the App is also governed by our Privacy Policy. Please review it carefully.

10. Intellectual Property

The App, Website, and associated content (including text, design, and code) are owned by OkCheck.app. You may not copy, modify, distribute, or create derivative works without permission.

11. Termination

You may stop using the App at any time by deleting it from your device. We may suspend or discontinue access to the service if required for security, compliance, or maintenance reasons.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

13. Changes to These Terms

We may update these Terms from time to time. The effective date above indicates when the latest version took effect. Continued use of the App after changes constitutes acceptance of the updated Terms.
